Hello, I have a condo that was my primary residence that I rented out when I got married and then purchased my home with my now wife. We live in Massachusetts with 4 kids. My Condo was an interest only arm loan with no equity, I lost several tenants, lost my job and now have a job making much less. I had to stop paying on the condo when I lost my job and I tried to short sale it with no success. It is schedule for a foreclosure auction. If the bank comes up with a deficiency judgement, how is that calculated? I owe $290k. If they sell it for only $150k, is the deficiency judgement for $140K? I will not be able to pay that back. I will end up having to file chapter 13 bankruptcy, I don’t think I qualify for chapter 7. this condo is not in my wife’s name, but will they take her income into consideration if I file bankruptcy? If so, it will have to be chapter 13 bankruptcy. If I file chapter 13, how do they determine what amount I pay back? I can not pay $140k, how much of that will they make me pay? We have four kids and our primary home to pay for. Help me to understand this all. Thank you.

Good, God. I could only tolerate about 15 seconds of each, but I will have to say 50 Cent on this one!
I am a first time home-buyer in Massachusetts, and I want to use the first time home-buyer tax break as down payment. Now that the program for the tax credit has been extended into April of 2010, can a buyer still use this program, and how can I use it? I have looked all over the Web and cannot find updated information about the rules governing this kind of sale, any advice would be appreciated.
Thanks for all this feedback so far, this is excellent. A few points to add: I know that some states, (MA included) have allowed people to use the tax break as a down payment (or monetize, as a few people said) - my primary question is if this ‘ability’ was extended the same as the tax break was also extended. It sounds as if the consensus is that it would have to be done on a lender-by-lender basis.
Also, I am looking to purchase a multi-family home so that it would be both my primary residence and an investment. so in this regard I don’t think it would be foolhardy to take advantage of the opportunity if it were available. I currently pay more in rent that I would be paying for a mortgage for a property I have been looking at.
See if you can get a loan against it, or if you are 100% sure you will be able to close a deal, change your tax withholding with your payroll department at work to be single 9, which will give you a boost in take home pay, and effectively get the credit now (since you will not need as much withheld from your pay when you file taxes next year if you get the credit). Just be sure to put the extra cash away somewhere safe in case you don’t close on a house, so you can make estimated tax payments to "repay" this extra take home pay later.

I was using four beautiful, black rims that were very unique on my 2003 Mitsubishi Lancer Evolution. On Wednesday last week, I took the rims off the car and put on a new set for the winter season. Since I live in a ridiculously safe town, I put the four black rims in the backyard. I run a home garage and keep a lot of car parts outside and I never have had a problem in 15 years. I went to New York from Massachusetts last weekend to help my brother move. When I came back, I noticed the four black rims where gone - they had been stolen. I’m an active member of a car club in Massachusetts and told them of my problem, and asked them to look out. Within an hour, I was getting private messages, all redirecting to one website - and there it was, 4 rims for sale - and exactly mine. I know they’re mine. They have the same logo on the hub cap that I painted myself. It’s impossible that they’re not my rims, stolen. Although, the seller is selling them for 1/3 of their actual value, ha ha. I first contacted my friend, who owns the website in question. He got me the user’s cell phone number, the town they live in, and a picture of him, and his job. Basically, he’s a landscaper, he saw my rims on my EVO and liked them, noticed I put on snow tires, and then stole them. He lives about twenty minutes away. I contacted the police. They wouldn’t help, longer story. I’ve had four of my friends contact the user in an attempt to buy the rims and then see where that takes them, and no response yet. What should I do now?
Have your friend buy them. Once he gets them, get any and every kind of documentation (pictures help a lot especially with that custom decal) that the rims your friend received are in fact your rims. Take pictures of the deal going down and everything. Return to the cops with all that evidence and they will have pretty much no choice but to pursue your complaint. If for some reason they still refuse then go to the media.
